Sale of original prints, reproductions, calendars, online photo workshops and photo trips

I - Terms and conditions

The purpose of the present General Sales Conditions (hereafter referred to as " GCS ") is to inform any client (hereafter referred to as "the client") purchasing an original print or a reproduction or a calendar or a photo trip and workshop, on the conditions and modalities with which Axel Azni Photography (hereafter referred to as "the photographer") proceeds with the sale and delivery of photographs and calendars, and to define the rights and obligations of each of the parties.

Only the particular conditions that may be stated in an estimate and the present GCS regulate the conditions of sale proposed by the photographer. They shall prevail over any clauses and conditions to the contrary that may appear on orders or other documents issued by the client.

 

1 – APPLICATION

Any purchase of original or reproduction photography or a calendar or a photo trip and workshop entrusted to Axel Azni Photography, whose SIRET number is 82336246200017, is subject to the present CGV. Acceptance of the quote implies the client's full and unreserved adherence to the GCS. No special condition may, except in the case of a formal written exception signed by the client and the photographer, and appearing on the quote that has become firm and definitive, prevail over these GCS. The photographer reserves the right to modify the content of these GCS at any time and without notice. The applicable GCS are those in force at the date of purchase of the photograph(s), and are also sent with the quote by email to the client before the latter makes his payment, which constitutes final acceptance without reservation of the conditions mentioned.

 

2 – PRODUCTS

The present general conditions of sale apply to the sale of original prints or reproductions of Axel Azni Photography's photographs, calendars and online services (workshops).

 

3 – PRICE

The amount of the original photographs or reproductions is expressed in euros (€). In accordance with article 293 B of the General Tax Code, VAT is not applicable to this type of product.

The amount includes:

  • The photograph(s) under the conditions previously agreed between the client and the photographer (original or reproduction, paper only or laminated, laminated or not...)

The amount does not include:

  • Shipping costs

  • Any insurance

Prices are subject to revision at any time. Only the price indicated on the website at the time of the order is definitive.

 

4 – TERMS OF PAYMENT

Payment of the total amount of the purchase is due as soon as the order is placed, and within a maximum of 30 calendar days from the date of the order. This payment can be made by bank transfer, cash or cheque.

Any delay in payment will result in the payment of a fixed penalty of 40 euros.

 

5 – CANCELLATION

5.1 – Cancellation by the customer:

Pour les annulations reçues avant l’impression des photographies, le montant versé sera intégralement remboursé.

Pour les annulations reçues après l’impression des photographies, le montant ne sera pas remboursé, quel que soit le motif de l’annulation.

 

5.2 – Cancellation by the photographer:

In case of physical or material incapacity, the photographer reserves the right to cancel an order. The cancellation may then result in a refund of the amounts paid by the client or in the issue of a credit note, for an amount corresponding to the sum paid at the time of the order, valid for 12 months.

The photographer will not refund any costs incurred by the client for the order (payment dispatch costs: bank transfer, post office...).

 

6 – RESPONSIBILITY

The photographer undertakes to do everything in his power to ensure that the exchange runs smoothly, from order to reception.

However, the photographer will not assume responsibility for services that he cannot control (service provider, transport, etc.). Under no circumstances will the photographer be held responsible for unforeseeable incidents or events outside his control, additional costs, material damage, loss, theft, delays and/or economic losses caused by third parties.

 

7 – FORCE MAJEURE

The photographer cannot be held responsible for any damage or loss suffered by the client due to any fortuitous event or force majeure such as any act emanating from a civil or military authority, de facto or de jure strike, fire, flood, water damage, storm and lightning, accident, riot, attack, any event attributable to a third party, or any other circumstance having an external cause and preventing the photographer, directly or through a third party, from fulfilling his commitments.

 

8 – CONFIDENTIALITY

All information provided by the client at the time of the order and payment remains confidential and the photographer undertakes to respect the legislation in force on the protection of personal data and privacy. Consequently, the photographer undertakes not to pass on this information to third parties in any form or under any conditions. It is reminded that the client has the right to access and rectify data concerning him/her in accordance with the French law on data processing and freedom of 6 January 1978.

 

9 – NULLITY

If any of the provisions of these GCS are found to be null and void with regard to a rule of law in force or a judicial decision that has become final, it shall be deemed to be unwritten, without this leading to the nullity of the present contract or altering the validity of its other provisions.

 

10 – COMPLAINT

Any complaint from a client must be made within three days of receiving the order. The photographer's liability is limited to the value of the service provided to the client.

 

11 – JURISDICTION

Any dispute relating to the interpretation and execution of these general terms and conditions of sale is subject to French law. In the absence of an amicable resolution, in the event of a dispute over the terms of this contract or non-execution, the parties grant jurisdiction to the Courts of Paris for the interpretation and execution of the contract and its consequences.




II - Terms et conditions of the Photo Trips

1 - DISCLAIMER

The visit always depends on the weather conditions, but there are many other options in case plan A fails. Plan B may well prove to be even better.

2 - CANCELLATION AND REFUND POLICY

2.1 - The deposit is refundable* in the following situations:

  • The tour is not full at the time of cancellation

  • The tour is full, but we have managed to find a replacement

*Axel Azni Photography is entitled to deduct a service charge of €100.

2.2 - Refund policy regarding full payment (which is mandatory 60 days before the start of the tour):

  • Fully refundable when you find a replacement less a possible service charge of €100

  • A service charge will be made for the participant's time and marketing expenses up to €100.

Where a replacement cannot be found at any time prior to the start of the visit, the following refund amounts apply:

Cancellation 60 days or more before the start of the visit: Full refund less €100 service charge.

  • 45 days or more: 75% refund

  • 31 days or more: 50% refund

  • Less than 31 days: No refund

Where a replacement has been found, any discount made will be deducted from the refund amount. The amount received will be refunded.

2.3 - Change of circuits

Where the participant wishes to cancel between 90 days and 8 weeks before the start of the trip, the deposit and payments made can be transferred to any other date of the trip.

Refunds will be made by the same method as the original payment. Refunds will be made within 72 hours of the request being approved.

3 - RISK RECOGNITION

Axel Azni Photography (hereinafter referred to as "the photographer guide") agrees to the following: Although the Photographic Guide has taken reasonable steps to provide me with appropriate equipment and a qualified guide, so that I may enjoy an activity for which I may not be competent, the Photographic Guide has informed me that this activity is not without risk. Certain risks are inherent in every activity and cannot be eliminated without destroying the uniqueness of the activity. These inherent risks are the same elements that contribute to the uniqueness of this activity and may result in loss or damage to my equipment, or in accidental injury, illness or, in extreme cases, permanent injury or death. The activity leader does not want to frighten me or reduce my enthusiasm for the activity, but feels it is important for me to know in advance what to expect and to be informed of the inherent risks.

Some, but not all, of these risks are described below: weather events such as storms, lightning and high winds; exposure to heat, cold or cold water resulting in hyperthermia, hypothermia, heat exhaustion and heat stroke; injuries related to hiking over rough terrain or falling from heights, such as muscle or joint sprains and strains and fractures; drowning in ocean waters or inland waterways; injuries related to physical exertion, including exhaustion, stroke or heart attack; and damage to photographic equipment.

I am aware that nature photography involves risks of injury or death to any participant. I understand that the description of these inherent risks is not complete and that other unknown or unforeseen inherent risks may result in injury or death. I agree to assume and take full responsibility for the inherent risks identified in this document and for inherent risks not specifically identified. My participation in this activity is purely voluntary, no one is forcing me to participate and I choose to participate despite and with full knowledge of the inherent risks.

I acknowledge that participation in this activity may require a different level of skill and knowledge than other activities and that I have responsibilities as a participant. I acknowledge that the photographer guide has been available to explain to me in more detail the nature and physical demands of this activity and the risks, hazards and dangers inherent in this activity. I certify that I am fully capable of participating in this activity. I therefore assume and accept full responsibility for myself, including any minor children in my care, custody and control, for personal injury, death or loss of personal property and expenses resulting from the inherent risks and hazards identified herein and inherent risks and hazards not specifically identified, and, due to my negligence in participating in this activity.

4- UPDATE - COVID-19

(Updated in October 2020)

Although the travel and security situation around COVID-19 has improved, there is still uncertainty at this stage as to when a vaccine will be available. From what we have read so far, this should be before the planned travel takes place. When you feel comfortable going on tour again, you can be reassured by our COVID-19 travel policy.

5 - NEW FLEXIBLE BOOKING CONDITIONS

A full refund will be made:

  • In case of cancellation of the trip by us for any reason.

  • In the event of cancellation due to a COVID-19 related problem, at any time prior to the start of the trip (border closure, quarantine on arrival...). If you are positive or a contact case you will need to present proof of your status to claim any refund.

  • You can transfer your trip to another tour free of charge up to 45 days before departure for any reason.

Good practices for participating in a tour/workshop

Although the first dates of our tour are still far away and the situation is changing rapidly, we can already assure you that we will follow the latest governmental guidelines before and during the tour. Therefore, we also expect our participants to follow the instructions of the tour leaders at all times. More detailed information about the preparation of the tour and the effect that COVID-19 will have on it will be communicated later, when the tour dates are closer.

Booking flights

We strongly recommend that you wait with your flight bookings or only book flexible/refundable tickets. Axel Azni Photography cannot be held responsible for financial losses due to flight cancellations prior to travel.
